Resolution: Increased Funding for Local Housing Authorities
WHEREAS access to safe, aordable housing is essential to the well-being
and stability of residents in Saskatchewan communities; and
WHEREAS local Housing Authorities play a critical role in managing and
maintaining aordable housing units for low- and moderate-income
residents; and
WHEREAS rising costs for maintenance, utilities, insurance, and staing have
placed significant financial strain on Housing Authorities; and
WHEREAS current provincial funding levels are insuicient to maintain
housing stock, address deferred maintenance, or meet increasing community
demand;
THEREFORE BE IT RESOLVED that the Saskatchewan Urban Municipalities
Association (SUMA) lobby the Government of Saskatchewan to increase
funding to local Housing Authorities to ensure the sustainability,
maintenance, and expansion of aordable housing in all Saskatchewan
communities.
ECWC Courage & Community Dinner
As part of the Estevan Community Wellness Committees mission to enhance safety and well-being in
the community of Estevan, the committee is planning our second annual Courage & Community Dinner
on January 19th, 2026 at the Beefeater Plaza. Often referred to as the saddest day of the year, our
committee wanted to change the narrative around Blue Monday, making the day one of courage,
community, and joy by uniting people to raise awareness of mental health and local resources. Our hope is
that we all can continue to support each other and develop stronger connections and a healthier
community.
Our guest speaker for the evening will be Tyler Smith, who will share his experiences on overcoming
adversity and the mental health struggle that ultimately came from the trauma he went through after
surviving the devastating Humboldt Broncos bus crash. He now spends his days as an advocate for mental
wellness, community building and sharing the message that no one is alone – it’s okay to not be okay .

7. Old Business and review “to-do list from last meeting
a) SLW/Loud-In-The-Library Concert This event took place on Saturday, October 11th, with a live
concert from local musical group Porphyrois. The concert went over well with over 40
attending. The plan is to bring Porphyrois back again next year.
b) Fall Book Sale Setup and Volunteers: The set-up for the Fall Book Sale will be on Wednesday
October 22nd. Several volunteers are expected to assist.
c) Fall Book Sale Clean-Up Volunteers: The clean-up for the Fall Book Sale will be on Sunday,
October 25th at 1:00 p.m. Several volunteers are expected to assist.
d) Local Author Day @ The Estevan Public Library: This event took place on Saturday, September
20th, and the event was well-received. Over 60 participants attended the event, and the 14 local
authors who participated were very appreciative of the event.
e) Update on Branch Assistant Staff: Two new Branch Assistant Staff were hired by the Southeast
Regional Library. Their names are Susana Lawrence and Danika Arnot. They will be working
mainly at other branches for the Southeast Regional Library, but will also be working at least one
shift a month at the Estevan Public Library Branch.
f) Update on Fall Programs: Fall programming is progressing. Both the Adult and Teen
Programmers have been doing Children and Tween programs and will continue this duty until
the end of the year.

8. New Business
a. Holiday Mini-Golf Event: This annual event will be returning and will run from December 5th
through the 7th. The price to participate is Free, but a donation box will be set up at the start of
the Golf Course.
b. Holiday Decorations for the Mini-Golf Event: A call was put out to the board for Holiday
Decorations that will be used for the Holiday Mini-Golf event.
c. Christmas Social Event: This will be taking place again in 2025. The date of the event will be
Thursday, December 11th. Details of the event are in the process of being put together.
d. Community Initiatives Fund/Canada Summer Jobs: Jason Redshaw is in the process of
reviewing which Summer Student Grant to apply through either the Community Initiative Fund
or Canada Summer Jobs. There is no option to apply for both one or the other must be
selected.
e. Staff Holiday Gift Cards: Jason Redshaw will be picking up the Staff Holiday Gift Cards from Co-
Op. Nancy Samoluk will put together the cards.
f. Board Appreciation Dinner: The plan is to have the dinner on either February 18th or 25th. A
final date will be selected in the next board meeting. The dinner will be taking place at the
Fired-Up Grill.
g. Remembrance Day Display Ideas: Nancy Samoluk will be bringing the cross for the front
window display
h. Holiday Display Ideas: Discussed holiday decoration ideas. The Book Tree will not be going
back up since it has been done for the past few years.
i. 2026 Board Members/Front Window Display: Jason Redshaw will be putting together a list of
special days and events taking place in 2026. This will be used as a guide for any board
members who wish to put up a front window display in 2026.
j. Semi-Annual Trustee Meeting: Discussed the upcoming Southeast Regional Library Semi-
Annual Trustee Meeting taking place on Saturday, November 1st.
k. Ongoing EPL Website Updates: The main menu selection was changed on the website to
improve navigation.
l. EPL Holiday Hours: The library will be closed on the days of December 24th, 25th, and 26th. The
library will also be closed on December 31st and January 1st. Full holiday hours will be posted on
social media and the website.
m. New Staff Name Tags: New Name Tags are being put together and will be available for library
staff before the end of the month.
n. 2025 Board Training: Board training will be taking place on Monday, November 24th, in the
evening. The training will be taking place over Zoom, but will also be taking place in Program
Room A.
o. Bambu Labs P2S Printer Purchase The purchasing of the Bambu Labs P2S Printer was
discussed. A grant from the RBC will assist with the purchase of the new 3D Printer. It was
agreed that a two-year warranty would also be purchased with the printer. The total cost of the
printer, accessories, warranty, shipping, and taxes will be around $1,500.00 around the same
amount as the RBC Grant.

RE: Pebbles to Rocks Day Care
ITEM OR INQUIRY:
The City has received a request for an amendment to the current sales and development
agreement for the Pebbles to Rocks Daycare project.
BACKGROUND AND DISCUSSION
Construction of the Pebbles to Rocks Daycare facility is progressing well. Based on the most
recent Municode inspection, the building structure is largely complete, and the builder
anticipates that the facility will be ready to open in the first half of 2026. Outdoor
landscaping is expected to be completed during the spring construction season.
To help ensure the project continues to move forward smoothly, the City is exploring options to
support the next stage of development. The required mortgage financing for project completion
is approximately $1.8 million. Administration is recommending that the City provide a loan
guarantee for this amount and enter into a lease agreement with Pebbles to Rocks until the
mortgage is fully repaid.
Financial projections provided for the daycare indicate that all loan payments associated with the
mortgage are expected to be fully covered through the normal operations of the daycare.
Legal Services is currently preparing the necessary contract documentation and identifying any
amendments required to the existing agreement to facilitate these arrangements.

That Council consider the proposal and provide direction to Administration to proceed with
amending the current sales and development agreement in alignment with the City’s continued
support for the project.

RE: Day Care Business Fees
With the fees bylaw being opened for update, this is an opportunity to address a concern from
Economic Development as it related to home day care fees. Note that this is different from
licensed day cares that are a commercial use in home or commercial areas.
After discussions with Economic Development, it has been proposed that the fees for in-home
day cares, currently a home-based business class II, be reduced to encourage greater participation
among existing home day cares and to make it easier to create additional home day care
businesses in the city.
While our fee is significantly larger than peer municipalities, our fee also includes a taxation
component which is not included in the fees in those other municipalities. The majority of the
business license fee is what would normally be viewed as property taxation. This is an
alternative to a split assessment from SAMA for a typical basement being used as a home-based
business.
Some of our peer municipalities use the SAMA approach. Most just ignore the matter and don’t
address property tax issues as part of home based businesses, at least that was found to be the
case about a year ago when I did a survey on the matter. Estevan implemented this approach to
address inequities between brick and mortar businesses and those offering same or similar
services out of the home.
All in, the cost for setting up a home day care is $250.00 for the development permit, $300 for
the business license and $100 for the fire inspection (if necessary) for a total cost of $650 to set
up a home day care. Data from Economic Development indicates that this may be a deterrent to
growth in this area. This works out to $1.78/day in year one and in successive years $0.82/day.

A number of ideas have been discussed to address this matter. These include:
Lowering the fee structure:
Have a permanent fee reduction for Home Day Cares within the fee structure or even have
Home Day Cares as a separate category. This would be easy enough to administer, but may
create a backlash from commercial operators that can be subject to commercial taxation on
the floor area that is used for commercial purposes. This was experienced with the hair
salons which were banned in the residential areas until a solution was found.
Allowing a graduated fee:
This approach was proposed to allow for day cares to have a break during startup. As an
example, in the first year of operation the fees for business licenses could be reduced.
Similarly, the fee for the development permit could also be reduced. This could be looked
upon as being consistent with what the City is doing to encourage brick and mortar
businesses to start up with reduced land prices or taxation exemptions.
A provision could be added to both the Planning Fees Bylaw and the Business License
Bylaw to allow for Council to a fee reduction on priority businesses. A sample wording is
provided below.
Following consultation with the City of Estevan Economic Development, Land Development
Services may recommend for Council consideration a partial fee waiver for a particular
business class should it be determined that the business class is a priority business within the
City of Estevan and the waiver would encourage growth in that economic sector. Said
partial fee waiver would be passed by Council motion and would be valid for the calendar
year.
This proposal was suggested since the backlog today is day care spaces. In a couple of years,
it could be something else. A provision like this would allow the community to rapidly
respond to changing priorities.
We are available to discuss this further with you at your convenience, though it would be good to
get this determined soon so that the necessary administrative bylaws can be amended in time for
the 2026 rush.

The City of Estevan Emergency Measures Organization has been working to re-structure our
organization to better align the goals of the organization with the needs of our residents. There is
an opportunity to apply for funding assistance through the Targeted Sector Support Initiative
through the Saskatchewan Urban Municipalities Association, the City of Estevan would be
eligible for this funding should council pass a resolution in support of applying for the funding.
BACKGROUND AND DISCUSSION
If funding was approved the funds would be allocated to hire a consulting firm to come in and
develop an Emergency Management Plan for the City of Estevan and the RM of Estevan.
Accessing potential funding would enhance our ability to strengthen local resilience without
placing the full cost on the City of Estevan. This is a cost shared basis and the TSS Initiative
offers 75% of the project’s eligible costs to a maximum amount of $100,000.00. The City of
Estevan and the RM of Estevan would be responsible for the remaining 25% of the costs and that
would be split between the 2 partners should resolutions be passed through both councils.
RECOMMENDATIONS
Estevan City Council pass a resolution in support of applying for the funding made available
through the Targeted Sector Support Initiative.

A cost-shared grant program that uses a portion of Municipal Revenue Sharing ($1.5 million per fiscal year) to

Projects under this program are intended to assist in supporting more efficient and effective municipal service
delivery, and enhanced governance and administrative capacity in Saskatchewan. Partnering municipalities can apply
for up to 75 per cent on eligible project costs to strengthen their core municipal responsibilities.
Who leads the Targeted Sector Support Initiative?
The Targeted Sector Support Initiative is managed by SUMA on behalf of the TSS Steering Committee consisting of
SUMA, SARM, New North and the Government of Saskatchewan.

RE: November 2025 Monthly Water Quality Report
In accordance with the Environmental Management and Protection Act, the operational staff of
the Water Treatment Plant are required to provide the owner (City Council) with a monthly
update on the quality of water leaving the treatment facility. The following report outlines the
key operational data and updates for the month of November.
During the month of November, the Water Treatment Plant processed a total of 96,773,900 liters
of water. Of this, 92,559,400 liters were distributed into the municipal water system.
Additionally, the bulk water fill station dispensed 503,990 liters of water.
There were no operational upsets at the plant, and all regulatory parameters for drinking water
quality were met in full compliance with provincial standards.
We are still conducting tests on the Wellock fill line to get higher flows for when Smith Street
reservoir is shut down fall 2026. This will enable us to output higher flows to Wellock reservoir
to maintain water levels throughout the city.
We have found that Perkins transmission line has high tuberculation and could possibly be a
potential candidate for swabbing in the 2026 year to help create more aesthetically pleasing
water for the businesses along Perkins Street 100 block.
Under the guidelines set by the Water Security Agency, we are required to notify Council of any
water main breaks within the distribution system. The City of Estevan follows a self-governing,
approved process to ensure that any such incidents are addressed promptly and safely.
There was one water break on Maple Bay that was quickly repaired and sampled. The repair was
found to be a broken service saddle. This was the only water break for the month of November
2025.

Proceeding to Request title.
The second phase of tax enforcement involves several steps enabling the municipality to request
title to land with arrears of taxes.
•Council passes a resolution to authorize proceedings to request title to a parcel of land.
•Depending upon the assessed value of the property and certain other factors:
oOne or more prescribed notices will be sent to certain parties.
oThe municipality may need to obtain approval from the Provincial Mediation Board
prior to requesting title.
•Council authorizes acquisition of the title in settlement of tax arrears.
Authorizing Proceedings to Request Title
Six months after the tax lien has been registered the council may authorize the Tax Assessor, by
resolution, to start proceedings for title. Council now has discretionary authority to delay
authorization of proceedings until such time as council deems it appropriate to begin.
a) The tax arrears are relative to the value of the property; or
b) The owner has abandoned the property
After council authorizes proceedings for title, the Tax Assessor has authority to carry through the
procedures until the municipality is ready to request ISC to transfer title. Tax enforcement
proceedings should be suspended only if the council passes a resolution to that effect.
At any point the land can be redeemed by any person paying the arrears and the costs as specified in
Section 19. This will stop the tax enforcement process, and the tax lien will be withdrawn. As
legislated under The Tax Enforcement Act.

At any time after the expiration of six months from the date on which the municipality’s interest
based on a tax lien was registered in the Land Titles Registry, the municipality may, by resolution,

arrears of taxes have not been paid and the interest based on the tax lien has not been discharged.

Land Development Services would like Council consideration to update the City’s Business License
Bylaw No. 2022-2060.
BACKGROUND AND DISCUSSION
The Business Licensing Bylaw sets the framework for Businesses to obtain licenses that permit the
operation of the business within the City. Proposed amendments are outlined in red on the attached
document. Changes include:
A definition of Bed and Breakfast which will include the term “short term rentals” and “Airbnb”
within the context of the Bylaw. This is necessary because there are a variety of terms used for this
use, as well as literally 100’s of web-platforms.
A clarification on license transfers.
A clarification on the pro-rating of license fees.
Clarification on the subject of license transfers.
Formal addition of a fee reduction for home based businesses that change location after establishing
themselves in compliance with City Bylaws. The fee reduction policy dates to a directive from the
previous Council.
The mechanism to adjust fees for priority businesses where the fees may be viewed as a deterrent to
the future growth of the community.
Strengthening of the provisions describing where a business license or application may be denied due
to concerns for the safety, health or welfare of the public.

Sign Advertising Businesses are formally included with the scope of the Business License Bylaw.
These businesses were covered under the current Bylaw, but new provisions are added to assist with
compliance monitoring.
License fee schedules have been moved to the City of Estevan Fees Bylaw. No fee increases are
proposed for 2026. The major change in this area is to clarify that a commercial business within a
dwelling (i.e., licensed day care) and a home based business with in-home client visitations (i.e., hair
salon) would be subject to the identical fee.
CONSIDERATIONS:
This Bylaw requires three separate readings from Council to come into force. Until that time, the current
Bylaw will remain in place.
RECOMMENDATION:
It is recommended that Council consider the proposed changes to the current Business Licensing Bylaw
and approve the submission of the draft bylaw for formal consideration.

A BYLAW OF THE CITY OF ESTEVAN TO PROVIDE FOR THE LICENSING OF
BUSINESSES OPERATING WITHIN THE CITY OF ESTEVAN
WHEREAS, the Council of the City of Estevan, in the Province of Saskatchewan has deemed it
necessary to establish a licencing and regulatory system for the carrying out of business, business
activities and persons engaged in business pursuant to Section 8(h) of the Cities Act.
NOW THEREFORE, the Council of the City of Estevan, in open meeting, enacts as follows;
PREAMBLE:
1) That this Bylaw be known as the City of Estevan Business Licensing Bylaw.
2) That City of Estevan Business Licensing Bylaw 2022-2060, and any amendments thereto, be
rescinded.
3) This Bylaw shall:
a) establish a structure for the regulation of businesses,
b) compliance monitoring with land use, fire and building regulations, and
c) be an aide to short and long-term economic development and land use planning
decisions.
PART I - INTERPRETATION
4) For the purpose of this Bylaw, the following words and terms are defined as follows:
a) Block Face means a portion of a street between two intersections.
b) Business means any of the following activities, whether or not for profit and however
organized or formed:
i. A commercial merchandising or industrial activity or undertaking;
ii. The carrying on of a profession, trade, occupation, calling or employment; or
iii. An activity providing goods or services.
as defined by The Cities Act, as amended.
c) Short-term rental means temporary lodging within a home on a commercial basis.
Short-term rental also includes “bed and breakfast”, “Airbnb” and other web-based
platforms. Short-term rentals are full commercial businesses within the context of
this Bylaw.
d) Business Premise means a parcel of land or a building where a business and any
related activities occur.
e) Charity means an organization that is:

i. Incorporated as a non-profit corporation in the Province of Saskatchewan;
ii. A registered charity authorized to issue tax receipts for donations pursuant to
the Income Tax Act; or
iii. An organization that can demonstrate it is formed for social, educational,
religious or philanthropic purposes from which the members do not receive
any direct economic gain.
f) City means the City of Estevan inclusive of all lands within the corporate limits of
the City of Estevan.
g) Contractor means a person who constructs, alters, maintains, repairs or remove
buildings or structures, installs heating plants, plumbing or other fixtures or performs
other similar work in the City and who does not have business premises in the City.
h) Designated Officer means a person designated by Council or the City Manager to
carry out duties pursuant to this Bylaw.
i) Direct Sales Contractor means a person who does not have business premises in the
City and who sells, offers for sale or solicits orders for:
i. Constructing, altering, renovating, maintaining, repairing, adding to or
improving a building that is used or is to be used as a house by the owner,
occupier or person in control of it; or
ii. Altering, maintaining or improving real property to be used in connection with
a house.
j) Direct Seller means a person who does not have a business premises in the City and;
i. Goes from house to house selling or offering for sale, or soliciting orders for
the future delivery or goods or services; and/or
ii. By telephone offers for sale or solicits orders for the future delivery of goods
or services.
k) Farmers Market means a group of persons operating collectively which sell
products that they make, bake or grow.
l) Garage Sale means a sale for used personal items or crafts made by a person within
the home on a residential lot for a period of no more than three consecutive days.
m) Hawker means a person who:
i. goes from place to place selling or offering to sale any merchandise or service
to a person; and who is not a wholesale or retail dealer in merchandise or
service with a permanent place of business in the City of Estevan;
ii. offers or exposes for sale to any person by means of samples, patterns, cuts or
blueprints, merchandise to be afterwards delivered or shipped into the City of
Estevan; or
iii. sells merchandise on the streets or roads or elsewhere than a building that is
his permanent place of business or dwelling in the City of Estevan.

n) Home Based Business means any occupation, business, trade, profession, or craft,
including a bed and breakfast operation and home day care as defined in this Bylaw,
carried on by an occupant of a residential building as a use secondary to the
residential use of the building and which does not change the character thereof or
have any exterior evidence of such secondary use.
Home based business (Class I) is generally characterized as a business that has no
client visitations, uses light duty vehicles and uses a minimal amount of floor area
within the residence. May include education services such as music classes.
Home based business (Class II) is generally characterized as a business that has
client visitations and/or uses a larger area of the home or accessory business for
business purposes.
o) Legally parked means the standing of a vehicle on a public road right of way as
determined by the City of Estevan.
p) Licensing Officer means the person(s) appointed by the City Manager to administer
this Bylaw.
q) Minor means an individual under the age of eighteen (18) years.
r) Mobile Concession means a self-contained, self-propelled (motorized or muscle
powered) vehicle (truck and/or trailer) or cart containing appropriate equipment for
the type and method of prepared food served.
s) Mobile Concession Vendor means any person who offers food for sale from a
mobile concession.
t) Outdoor Recreation Area means any public park or sports field under the control of
the City of Estevan.
u) Pawnbroker means any person that lends money in exchange for personal property
that can be sold if the loan is not repaid in time.
v) Peddler means a retail dealer who brings goods from place to place and offers them
for sale.
w) Person includes business corporations, partnerships and sole proprietorships.
x) Prepared food means food sold by Vendors intended for immediate consumption
without further preparation/cooking.
y) Public Roadway means that part of a public street designated or intended for use by
vehicular traffic.
z) Public sidewalk means any sidewalk(s) included on public property.
aa) Trade Show means a place where the public is invited and where goods or
merchandise are offered for sale by retail or auction on a short-term basis such as
hobby shows, home improvement shows, sportsman shows, and craft shows.

bb) Transient Trader means a person carrying on business in the City who:
i. Offers goods or merchandise for sale by retail or auction; or
ii. Solicits any person who is not a wholesaler or retail dealer for orders for the
future delivery of goods, services or merchandise; or
iii. is a non-resident contractor providing a service
but, does not include a person who is required to be licensed pursuant to the
Direct Sellers Act or who is an occupant or property that is used for business
purposes.
PART II - LICENSES-GENERAL:
5) Subject to (6) below, no person shall carry on business within the City unless such person
holds a valid and subsisting license to do so issued pursuant to this Bylaw.
6) A license shall not be required for:
a) a business activity carried on by the City of Estevan;
b) an activity carried on by a minor;
c) a garage sale in compliance with this Bylaw;
d) a business carried on by the Governments of the Province of Saskatchewan, Canada
or a Crown Corporation created by either Government;
e) any person operating within the limits of the Estevan Exhibition Grounds during the
annual exhibition or other event as approved by City Council;
f) any activity carried on by a Charity or Community Club; or
g) any other activity or business that City Council may be resolution exempt from the
requirements of this Bylaw.
7) A person shall apply in writing to the City for a license prior to commencement of the
business.
8) For clarification, the activities of a contractor or subcontractor providing goods or services to
another business within the City is a business activity within the meaning of this Bylaw and
persons who are contractors or subcontractors providing such goods or services are required
to obtain a license pursuant to the terms of this Bylaw.
9) A person may conduct business activities from more than (1) premises under a single
business license, provided that:
a) each premises is identified on the license as a location at or from which the person
intends to conduct his/her business activities; and
b) only one location is a physical “brick and mortar” store; and
c) similar business activities are being conducted at each such location; or
d) the nature of the business is such that the business provides services in various
locations as a normal practice (i.e., a carpenter or a home care nurse).

APPLICATION:
10) An application shall include all of the requested information, including:
a) Contact information for the applicant (name, phone number, full mailing address);
b) Contact information for the landowner if different from the applicant (name, phone
number, full mailing address);
c) Contact information for the business owner (name, phone number, full mailing
address) if different from the applicant or landowner;
d) Proof of registration of the business name with the corporation branch or equivalent
federal or provincial agency;
e) Description of the nature of the business;
f) Address where business is to be carried out;
g) Area of the premise where the business will be carried out;
h) Any certificate, authority, license or other document of qualification under this or any
other bylaw, or under any Statute of Canada or the Province of Saskatchewan that
may be required in connection with the carrying on of the business; and
i) In the case of mobile concessions, proof of current registration when the mobile
concession is to be parked on a public roadway or operating on public property.
FEE:
11) A person shall remit a fee as provided for in the City of Estevan Fee for Service Bylaw when
applying for a license,
12) A license shall not be issued until the applicable fee has been completed.
13) The applicable fee is calculated by the Licensing Officer, based upon reasonably exercised
discretion as to the nature of the business and the information provided by the applicant.
14) Licenses are not transferable to other persons, corporate names or locations.
15) If a person makes or approves an application for a license after August 31st of the current
year, the applicable fee may be prorated at the discretion of the licensing officer for the
portion of the year remaining.
16) A business that ceases operation is not eligible for a refund, in whole or in part, of their
licensing fee.
17) Home Based Businesses that have been operating in compliance with City Bylaws for a year
or more may be eligible to a reduced renewal fee when the business re-locates to another
residence.
18) Following consultation with the City of Estevan Economic Development, Land Development
Services may recommend for Council consideration of a partial fee waiver for a particular
business class should it be determined that the business class is a priority business within the
City of Estevan and the waiver would encourage growth in that economic sector. Said partial
fee waiver would be passed by Council motion and would be valid for the calendar year.

TERM OF USE:
19) All licenses issued pursuant to this Bylaw shall expire after the 31st day of December of the
year in which the license was issued.
20) Any person to whom a business license has been issued that intends to continue said business
shall make application to a Licensing Officer for the renewal of the said license prior to
January 31 of the following year.
21) It is the responsibility of the person responsible for the business license to notify the City if
the business is discontinued or if the nature of the business changes.
DISPLAY:
22) Any license issued under this Bylaw must be displayed in a prominent place on the premise
of the business for which the license was issued.
23) Placards for the temporary parking of construction trailers on a City street must be
prominently attached and displayed on the trailer.
24) In the case of a transient business, the license holder shall produce his/her license when
requested by the Licensing Officer either at the time of request or within 48 hrs.
PART III – REGULATORY COMPLIANCE:
25) A license will not be issued under this Bylaw where the business does not conform to
applicable zoning or building requirement of the City.
26) The issuance of a license under this Bylaw does not relieve a person from the responsibility
to comply with any other municipal bylaw, requirement of the Province of Saskatchewan or
the Government of Canada.
27) The Licensing Officer shall refer an initial application for a business license to applicable
City Departments such the Building Official, Estevan Fire Department or Bylaw
Enforcement services with the Estevan Police Service.
28) As a clarification to (26) above, the City:
a) shall refer all licenses for cannabis related activities, body rub and/or massage
services or taxi services to the Estevan Police Department for their review and
comment; and
b) may require confirmation of satisfactory insurance and registration from
Saskatchewan General Insurance (SGI) for taxi services and a mobile concession.
29) If a person contravenes any term or condition of a license issued to him/her, the City may
suspend or cancel the license.
30) The City may reinstate a suspended license if it is satisfied that the licensee is complying
with this Bylaw.

31) In a prosecution for a contravention of this Bylaw, proof of one (1) transaction in the
business or that the business has advertised is sufficient to establish that a person is engaged
in or operates a business.
32) No person shall advertise a business or promote an activity for which a license is required
pursuant to this Bylaw unless said person holds a valid license to do so.
33) Following a review of the information provided to the Licensing Officer as part of a business
license application or during the operation of a business, if it is determined that it would be
inappropriate to issue a license to the applicant or to maintain a current license with the
applicant; the City may refuse to issue, cancel or suspend an existing license if it is
determined that the safety, health or welfare of the public may be at risk.
PART III – SPECIFIC LICENSES:
AUCTIONS:
34) No auction shall take place on public land, including roadways, parks, parking lots, etc.,
without the approval of the City Manager.
35) An auction license shall not be used for the purpose of pawnbroker services.
CONTRACTORS:
36) Contractors that operate within the City on an intermittent basis may have their license fee
adjusted at the discretion of the Licensing Officer.
FARMER’S MARKETS:
37) A license issued for a farmer’s market includes all businesses/persons that offer goods or
merchandise for sale at the said farmer’s market.
38) Farmers markets may include vendors for charities, public information campaigns, raffles,
etc.
39) Should the Licensing Officer determine that a certain business operating at a farmer’s market
should not be eligible for operation within the farmer’s market, the License Inspection may
require that business to vacate the said farmer’s market.
40) Where section (37) of this Bylaw is applied, the license for the farmer’s market shall be
maintained.

GARAGE SALES:
41) A garage sale is subject to the City’s sign regulations as set forth in the City of Estevan
Zoning Bylaw and the City’s Traffic Bylaw. (Private signage on City lands is generally
prohibited, please consult with the City Zoning Bylaw/Sign provisions for more information)
42) A garage sale may be held for four consecutive days with operating hours from 9:00 AM to
9:00 PM, except for Sundays where the closing time is 5:00 PM.
43) All signage related to a garage sale shall be removed by no later than 10:00 PM of the final
day of the sale.
44) Failure to remove garage sale signage may result in enforcement actions taken by the
Licensing Officer.
45) More than one home in a neighbourhood may collectively hold a garage sale in a single
location.
46) A garage sale may not take place at the same location more than once every three months.
HAWKERS AND PEDDLERS:
47) Hawkers and Peddlers shall not call on residents between 9:00 PM and 9:00 AM.
48) Hawkers and Peddlers shall not locate on public land or roadways without the written
consent of the City of Estevan.
49) Hawkers and Peddlers that offer meat fish, fruit, greenhouse products or other farm produce
outside of a farmer’s market shall be administered as a mobile concession.
MOBILE CONSESSIONS – FOOD CARTS AND FOOD TRUCKS:
General
50) No person shall operate a mobile concession on public or private land, public roadway,
outdoor recreation area, sidewalk or boulevard except as provided for in this Bylaw.
51) A license for a mobile concession may include requirements as imposed by City Engineering
Services, City Roads and Drainage and/or the City Fire Department.
52) The hours of operation for a mobile concession are limited to 8:00 AM to 9:00 PM daily
unless otherwise determined by a Licensing Officer.
53) Mobile concessions are approved on a first come first served basis.

54) The City may require as part of the business license application:
a) a sample menu, photo(s) or detailed drawings of the mobile concession,
b) A copy of written approval from Sask Health and where applicable, Sask Gas,
c) Approval of the City of Estevan Fire Department, and
d) Approval of the landowner when on private land.
Approved Locations
55) A mobile concession may operate at a residence for a period of 2 hours as part of a
celebration related to a resident of that property during the hours provided in (52) above.
56) A mobile concession may operate in residential, recreational or institutional/urban services
area, provided they do not remain in the same general location for more than 2 hours.
57) A mobile concession may operate in an industrial area for a period no longer than 2 hours on
any day.
58) Operating hours under this section do not include time taken for setup which is a maximum
of 1 additional hour.
59) A mobile concession may operate within a “block party” area as approved by the City of
Estevan for the duration of the block party.
60) A Licensing Officer may approve a longer operating time for Section (52), (53) and (55)
where the mobile concession is not to be located on a public roadway or sidewalk.
Prohibited Locations
61) A mobile concession shall not be less than 20m (66 ft.) from the entrance or outer wall of a
restaurant, whichever is greater, unless the restaurant owner agrees in writing to a lesser
distance. A copy of the written permission shall be provided to the Licensing Officer where
approval is granted for a lesser distance.
62) A mobile concession shall not operate within 20 m (66 ft.) of another mobile concession
unless both concession owner/operators agree.
63) On any block of a street adjacent to a school site on a school day between 8:00 AM and 6:00
PM. unless written permission is obtained from the school.
64) A mobile concession shall not be located within a loading zone or between a loading zone
and a store-front.

65) A mobile concession shall not be located on a public or private lot without the permission of
the landowner and City.
Sidewalk Carts – Location Criteria
66) No person shall operate a mobile concession from a public sidewalk or public land, unless
the operation complies with the following standards:
a) A minimum setback of 1.2 m (4.0 ft.) of sidewalk shall remain free of obstructions to
facilitate pedestrian movements between the concession and the curb or any other
physical obstruction such as a utility pole, light standard, fire hydrant or waste
receptacle.
b) Otherwise represent a danger to public safety.
c) The use of the sidewalk shall not impede access to a building entrance or exit.
d) No permanent alterations or attachments to the sidewalk or boulevard shall be
permitted.
e) Waste receptacles shall be provided and the area shall be left in a state of cleanliness.
All storage and waste containers shall be kept adjacent to the concession.
f) The owner/operator of the concession shall be responsible for maintaining and
keeping the adjacent sidewalk, boulevard and street clean at all times.
Mobile Concession – Location Criteria
67) There are no fixed locations for mobile concessions on public property. Locations for mobile
concessions are determined on a first come first served basis daily.
68) Vehicles shall not be parked at a vending location overnight unless part of a multi-day public
event.
Mobile Food Courts
69) The City may establish a mobile food court on private land or public land on or adjacent to
any parcel where a restaurant or eating establishment is an allowable use in the City of
Estevan Zoning Bylaw.
70) A mobile food court may consist of one or more mobile concession vendors and accessory
uses including, but not necessarily limited to: washroom facilities, picnic tables and
landscaping and customer parking.
71) A mobile food court shall require an approved development permit in accordance with the
City of Estevan Zoning Bylaw.

Insurance Requirements
72) An application for a mobile concession shall include:
a) A minimum of $2 million commercial general liability insurance and shall indemnify
the City of Estevan from any and all claims of injury to persons or damage to
property, attributable, in whole or in part, to that persons use of the City sidewalk or
any other portion of the City street.
b) Any person using a public roadway under the provision of this policy shall carry a
minimum of $2 million auto liability insurance on each owned or non-owned
vehicle/trailer associated with the business.
c) The City of Estevan shall be provided notice of cancellation or change to the
insurance policies.
d) The City of Estevan shall be listed as additional insured on all insurance policies.
SIGN ADVERTISING
73) Businesses that provide billboards or portable sign frames for advertising that are defined as
an on or off-premises sign under the City of Estevan Zoning Bylaw, shall require a business
license and are subject to the following business specific requirements:
a) full compliance with Zoning Bylaw and City Election advertising requirements, and
b) approved land encroachment agreements where the sign is located on City Controlled
Lands.
TRADE SHOWS:
74) A person shall obtain a license to operate a trade show.
75) Once a trade show license has been obtained, all participating businesses in the trade show
are included within the trade show license.
PART IV– CONTRAVENTION AND ENFORCEMENT:
Inspections:
76) The Licensing Officer is authorized to enter any property or premises in the City of Estevan
during normal business hours to:
a) determine if this Bylaw is being complied with, or contravened, as the case may be.
b) verify the accuracy of information provided by a person when applying for a business
license or the renewal of a business license; and/or
c) obtain any additional information from any person to whom a license has been issued
regarding the conduct of that person’s business activities that may be required under
this Bylaw.

77) Pursuant to Section 324 of The Cities Act, the City of Estevan shall appoint all Licensing
Officer’s and all inspections shall be carried out pursuant to this Bylaw and The Cities Act.
78) Landowner consent is required for a Licensing Officer to enter a residential dwelling or
accessory building. The Licensing Officer may apply to a justice of the peace or a provincial
court judge for a warrant pursuant to Section 325 of the The Cities Act should a residential
landowner refuse consent to enter.
79) No person shall obstruct a Licensing Officer who is authorized to conduct an inspection
under this Bylaw, or a person assisting a License Officer.
Violation Order:
80) A person who:
a) Obstructs or hinders a Designated Officer or any other person acting under the
authority of this Bylaw; and/or
b) Fails to comply with a provision of this Bylaw;
has committed or is alleged to have committed an offence under this Bylaw.
81) A person who commits or is alleged to have committed an offence for which a penalty is
described in Schedule A” of this Bylaw, a License Inspector or any other person authorized
by the Director shall issue a Violation Order to such person.
82) The Violation Order shall provide for the voluntary payment of a penalty in the amount set
forth in Column A of Schedule “A” for the offence which the person has or is alleged to have
committed.
83) If payment of the amount specified on the Violation Order is made on or before the date
indicated on the Violation Order, the person shall not be liable for prosecution for the offence
indicated.
84) If the payment of the amount specified on the Violation Order is not made the Licensing
Officer shall continue the enforcement of the Violation Order in accordance with Section
325, 326 and 328 of The Cities Act.
85) Where a penalty is not specified in Schedule “A”, a person who has or is alleged to have
contravened this Bylaw, upon summary conviction is liable to a fine:
a) For the first offence of $250;
b) For the second offence of $400;
c) For the third or subsequent offence of not less than $500 and no more than $10,000 in
the case of an individual or $25,000 in the case of a corporation.

PART V– GENERAL MATTERS:
86) If any section, sub-section, sentence, clause, phrase or other portion of this Bylaw is for any
reason held invalid or unconstitutional by any Court of competent jurisdiction, that portion
shall be deemed a separate, and distinct and independent provision and the holding of the
Court shall be affect the validity of the remaining portions of the Bylaw.

A BYLAW TO PROVIDE FOR THE CHARGING OF FEE
FOR SERVICES PROVIDED BY THE CITY OF ESTEVAN.
WHEREAS, pursuant to the Section 8 (1) (I) of The Cities Act the City may set service
charges for services provided and may set the time and place and the manner in
which they will be payable;
AND WHEREAS the Council of the City of Estevan deems it necessary and desirable
to do so;
NOW, THERFORE, the Council of the City of Estevan hereby enacts as follows:
1. That the following service charges shall be set as identified in Schedule A
2. The fees indicated in of this Bylaw shall be payable at the time of request.
3. FORMER BYLAW REPEALED
That Bylaw 2024-2087 of the City of Estevan, Saskatchewan and all
amendments thereto are hereby repealed; such repeal shall not prejudicially affect
any matter or thing whatever done, existing or pending at the time of such repeal.
EFFECTIVE DATE:
This Bylaw shall come into force and effect upon final passing.

Dear Mayor Sernick:
The CPKC Holiday Train is returning to Estevan to celebrate its 27th season of visiting communities across
the CPKC network and helping those in need.
Thanks to the generous support of great communities like yours, the Holiday Train has raised over $26.1
million and over 5.45 million pounds of food since 1999 to help people struggling with food insecurity.
With your help, we can continue to raise food, money and awareness for people facing hunger issues
across North America.
EVENT INFORMATION
Community: Estevan
Location: East of the CPKC Station at vacant lot off 7 St
Date: Friday, December 19
Time: 3:15pm
We will be in touch with you starting late October to discuss additional event information such as the
exact stop location, promoting the event, riding the train and confirmation you will be able to join us on
stage to help present a donation to your chosen charitable organization.

FOOD BANK/FOOD SHELF DONATION
CPKC will encourage community members to make donations to the local food bank of your choice in
the lead up to and at the event. In the past, your chosen organization was Salvation Army Estevan
Corps. If this has changed, please let us know which organization you would like to support this year
by Friday, October 10. If we do not hear from you by this date, we will liaise with the recipient we
donated to last time we visited.
HOSTING A SAFE AND FUN EVENT
Safety is always our top priority, and our goal is to continue to make the Holiday Train event safe and
fun for everyone. We ask your office to manage any road or crossing blockages related to this event,
including marking a safe perimeter around the Holiday Train for the duration of the show.
We have found that something as simple as “Do Not Cross” tape works well for this purpose, although
our preference, if possible, would be to erect barricades that clearly mark out the area. This offers a safe
zone for lowering the stage door, provides a clear space for people to board and leave the train and
helps to prevent people from trying to cross through the train. Additionally, police or security presence
at the event and at nearby crossings is encouraged to help ensure safe passage for the train into and out
of the event.
Members of the CPKC Police Service will be on hand to help manage crowds, but we do appreciate your
continued support including the involvement of your local enforcement officials in keeping the
Holiday Train event in your community a safe one.
CPKC HAS HEART
CPKC Has Heart is our community investment program aimed at improving the heart health of men,
women and children in communities across North America. Heart disease can affect anyone regardless
of age or gender.
Prevention is key to eliminating the effects of heart disease, and one of the ways we hope to help is by
spreading the message of the importance of quality nutrition. We encourage those attending Holiday
Train events to make a monetary donation or donate heart healthy food items, because regardless of
circumstance, we believe that everyone should have access to healthy, nutritious food.
SOCIAL MEDIA
We use social media to inform and invite community members to the event and encourage food bank
donations. Follow us on Facebook, Twitter and Instagram and share our message by using
#CPKCholidaytrain and #HealthyDonations.
