I-A2-01 PROPOSALS:
Cedar City requests bid proposals for supplies and/or services which are outlined
in these documents.
a.
FORM
: each proposal shall be submitted in a sealed envelope bearing the words City of Cedar City

b.
DISCREPANCIES: In the case of a difference between the amount written in words and the amount
written in figures, the written words shall govern.
c.
ENTRIES: Entries shall be legibly written in ink or typed.
d.
Alterations: Alterations of any kind on any page of the bid shall not be made:
e.
MODIFICATIONS: Modifications to the documents or oral proposals shall not be considered.
Alternate proposals shall not be considered unless specifically called for in the bid proposal. Inclusion
of alternate proposals when not called for may invalidate the entire bid.
f.
SIGNATURES: All proposals shall be signed by an authorized representative of the company, and
have the full business address written in the appropriate spaces.
g.
PROPOSAL DELIVERY: Proposals must be delivered prior to the time stipulated above; otherwise,
the proposal will be returned unopened. If forwarded by mail, the sealed envelope containing the bid
must be enclosed in another envelope, properly addressed.
h.
WITHDRAWAL: Any proposal may be withdrawn any time prior to the scheduled closing time for
receipt of proposals.
i. OPENING: Proposals shall be opened and publicly read aloud or handled as stipulated in the Public
Notice.
j. AWARD AND REJECTION: The contract will be awarded to the lowest and/or best qualified
responsible bidder. The City reserves the right to reject any or all proposals or waive any informality
or technicality in any proposal. All bids shall hold firm for a period of sixty (60) days after the date of
bid closing. Bids will not be considered complete and will therefore be rejected if all required Bid
Documents are not returned and complete at the time of the bid closing
.
Bids are to be quoted All or
None unless otherwise stipulated. A partial quote will be rejected.
ADDENDA: All addenda shall become part of the bid document and be included in the bid at the time
of the bid opening.

COMPLIANCE CERTIFICATION
OF 8 USC FOR ALL CONTRACTS BETWEEN
CEDAR CITY AND A
CONTRACTOR.
By submitting a proposal and by signing this certification and a contract with the City, Contractor certifies
that it does not and will not during the performance of this contract knowingly employ, or subcontract with
any entity which employs workers in violation of 8 USC § 123a. Contractor agrees to require all
subcontractors at the time tha
t
are hired for this project to sign a Certification of Legal Work Status and
submit the Certification to City prior to any work being performed by subcontractors. Contractor agrees to
produce, at the Citys request, documents to verify compliance with applicable State and Federal laws. If
contractor knowingly employs workers or subcontractors in violation of 8 USC § 123a, such violation shall
be cause for unilateral cancellation of the contract between Contractor and City. In addition, Contractor
may be suspende
d
from
participation in future projects with the City for a period of (1) year. In the event
this contract is terminated due to a violation of 8 USC § 123a by Contractor or a subcontractor of
Contractor, Contractor shall be liable for any and all costs associated with such termination, including, but
not limited to, any damages incurred by the City as well as attorney fees. For purposes of compliance, the
City requires Contractor and subcontractors to use E-Verify to verify employment eligibility of all
employees as allowed by law and the E-Verify procedures. Contractor and sub-contractors must maintain
authorized documentation of the E-Verify.

REQUEST FOR PROPOSALS
The City of Cedar City is soliciting competitive sealed proposals from qualified and licensed fireworks
dealers f
or the
2026
4
th
of July Celebration located in Cedar City, Utah.
The
City encourages all prospective companies to examine the RFP carefully. Qualified companies, as
defined below, are requested to submit proposals to provide fireworks as defined in the RFP.
REQUIRED QUALIFICATIONS OF COMPANY
The company must meet or exceed the following minimum qualifications:
a.
Have
at least five (
5) years experience in distributing fireworks
.
b.
Be properly licensed in the State of Utah
.
c.
Have
a
proper bid and performance bond
.
TERM OF AGREEMENT
The term of the resulting agreement is
for the
2026 through 2031
4
th
of
July shows
. The city may extend
the contract on an annual basis not to exceed
five
(5)
two
(2) year renewals under the same terms
subject to the conditions stated herein. The agreement
can
be
canceled by either party after providing
ninety (90) days written notice to the other party.
BACKGROUND AND SCOPE OF SERVICES
The
4
th
of July event will be held at Fire Station No. 3, 1600 North Lund Highway. Shells will be launched
from this location which has clearances to shoot up to 16 shells
.
Budget: The table below is an example of fireworks
shot in the past and is a guide for this RFP. T
he
budget for this show is not to exceed $26,000 for 2026 and $22,500 for 2027 through 2031
Fireworks: The vendor shall provide all fireworks and provide a State of Utah licensed shooter to set up

Insurance:
a.
General: Contractor shall secure and maintain insurance as required by laws and regulations and
the terms of this agreement to protect against liability, loss or expense which occurs or arises
as
a result of the performance of the services provided pursuant to this agreement or as changed as
provided herein. Consultants insurer must be authorized to do business in Utah and must have
an A.M.
best
rating
of
a VIII
or better at the time this contract is executed.
b.
Commencement of work: Neither Consultant, neither his suppliers nor any subcontractors shall
enter the site of the work or commence work under this contract before City has received and
accepted Certificate(s) of insurance and insurance endorsements and has issued the notice to
proceed.
c.
Insurance Certificates and Coverage: Insurance certificates shall be issued on all policies
required under this contract and shall be signed by an authorized representative of the insurance
company. The insurance certificate or the coverage required shall include the following:
a.
The name and address of the insured.
b.
City shall be named as certificate holder.
c.
City shall be named as an additional primary insured on the General Liability Certificate
and on a separate endorsement with City listed as non-contributory
.
d.
The location of the operations to which the insurance applies.
e.
The number of the policy and the type or types of insurance in force thereunder on the
date borne by the certificate.
f.
A Statement that all coverage is on an occurrence basis rather than a claims basis
except for the professional errors and omissions malpractice insurance coverage.
g.
A provision that the policy or policies will not be cancelled, denied renewal, or reduced in
coverage until at least 30-days after written notices has been received by the City.
h.
Name, address, and telephone number of the insurance companys agent of process in
Utah.
i. Other information to demonstrate compliance with additional requirements stipulated for
the various types of insurance coverage.
d.
Commercial General Liability Insurance:
a.
Consultant shall procure and maintain commercial general liability insurance for the
duration of the contract against claims for injuries to persons or damage to property
which may arise from or in connection with the performance of the work hereunder and
the results of that work by the Consultant, his agents, representatives, employees or
subcontractors. The insurance shall remain in effect during the term of this agreement
and such that claims reported beyond the date of substantial completion of this
agreement are covered and during the warranty period, to the extent that it relates to the
activities covered by this Agreement, in such manner and amounts as set forth herein.
b.
The Insurance Endorsement shall evidence such provisions.
c.
The minimum commercial general liability insurance shall be as follows:
i. Comprehensive general liability insurance for injuries, including accidental death,
to any one person in any one occurrence in an amount not less than $1,000,000
Dollars.
ii. Comprehensive general liability insurance for injuries, including accidental death,
to two or more persons in any one occurrence in an amount not less than
$2,000,000 Dollars.
iii. Broad from property damage insurance in an amount not less than $500,000
Dollars.
iv. Such policy shall include each of the following coverages
:
1.
Comprehensive form.
2.
Premises operations
3.
Explosion and collapse hazard
4.
Underground hazard
5.
Product/completed operations hazard
6.
Contractual insurance
7.
Broad form property damage, including completed operations
8.
Independent contractors for vicarious liability
9.
Personal injury
10. Fire and extended coverage with endorsement for vandalism and
malicious mischief in an amount of at least 50 percent of the contract
price
11. Cross liability or severability of interests clause shall be included unless
a separate policy covering City is provided.
BID BOND
All bidders shall provide a bid bond as security for the bid in the form of a 10% bid bond to
accompany their bid. This bid bond shall be issued by a Surety Company who is listed on the
U.S. Treasury Departments list of acceptable sureties as published in Department Circular
570. The bid bond shall be issued by an authorized representative of the Surety Company and
shall be accompanied by a certified power of attorney dated on or before the date of bid. The bid
bond shall include language, which assures that the bidder/principal shall give a bond or bonds
as may be specified in the bidding or contract documents, with good and sufficient surety for the
faithful performance of the contract, including the Basic One (1) Year Limited Warranty, and for
the prompt payment of labor and material furnished in the prosecution of the contract.
PERFORMANCE BOND, 1
YEAR
The successful bidder shall furnish a Performance and Payment bond (Bond) equal to 100
percent of the total contract amount within 30 days of the notice of award. Such Bond shall be in
a form acceptable to the Owner and issued by a surety company included within the Department
of Treasury's Listing of Approved Sureties (Department Circular 570) with a minimum A.M. Best
Financial Strength Rating of A and Size Category of XV. In the event of a bond issued by a
surety of a lesser Size Category, a minimum Financial Strength rating of A+ is required.
Bidder and Bidder's surety agree that the Bond issued hereunder, whether expressly stated or
not, also includes the surety's guarantee of the fireworks manufacturer's
.
Owner agrees that the
penal amount of this bond shall be simultaneously amended to 100% percent of the total contract
amount upon satisfactory acceptance and delivery of the fireworks included
herein. Notwithstanding anything contained within this contract
to the contrary, the surety's
liability for any warranties of any type shall not exceed one (1) year from the date of such
satisfactory acceptance and delivery, or the actual Basic One (1) Year Limited Warranty period,
whichever is shorter.
The cost for the bid bond shall be shown as a separate cost line item from the total cost of the
fireworks.
PREPAY AND DICSOUNTS
All prepay options and discounts shall be included in the original bid document.
