Dear Program Administrators:
The United States Probation/Pretrial Services Office for the Middle District of North Carolina is
soliciting proposals to provide treatment services for male and female federal offenders, who are drug
dependent, alcohol dependent, and/or suffering from a psychiatric disorder. These individuals include
persons on probation, supervised release, parole, or persons on pretrial release, who are under
supervision of the United States Probation Office. This group could also include inmates in the United
States Bureau of Prisons who are residing in federal or contract community treatment centers. The
services required may include outpatient substance abuse and mental health, residential substance
abuse, or sex-specific offense treatment, depending on the Request for Proposal (RFP).
Included is the RFP referenced above. The RFP contains the full text of all applicable Government
regulations, and all offerors are subject to the provisions contained in the RFP. In responding to the
RFP, you should answer fully each item and supply all information requested. Please read the RFP
carefully; do not rely on knowledge of previous RFPs, or knowledge of previous federal
procurement procedures.
Proposals will be awarded on the basis of initial offers submitted, and each initial offer should contain
your organization’s best terms from a price and technical standpoint. There will be no additional
opportunity to modify your proposal.
Although the Government may choose to enter into a Blanket Purchase Agreement with multiple
vendors, the Government reserves the right to award to a single vendor.
The term for this Blanket Purchase Agreement is 12 months, with a provision that shall allow the
Government to unilaterally extend the agreement for an additional 2 years, at the Government’s
discretion.

RFP REQUIREMENTS:
Section “L” provides specific directions for potential vendors in completing their proposals. All
proposals will be evaluated by the criteria identified in Section “M.”
Offerors must be capable of providing all services identified in Section B and C, within the geographic
area identified in Section “B.” The estimated monthly quantity listed in Section “B” of the RFP is the
estimate of the services to be provided during the term of the agreement. It is only an estimate. Section
“B” Pricing must be submitted on the forms provided in this proposal.
Your proposal must contain the following pursuant to Section L. All must be completed fully
and originally signed where applicable, use the forms provided in this proposal and attach pages
as needed clearly identified as subsets of the Attachment that it corresponds to:

AsaresultofthissolicitationtheGovernmentintendstoenterintoaBlanketPurchaseAgreement(BPA).For
thisBPA,approximately1to2vendorsareneededtoprovidetherequiredservices.TheGovernmentreserves
therighttoawardtoasinglevendor.
ABlanketPurchaseAgreementisa“chargeaccount”arrangement,betweenabuyerandasellerforrecurring
purchasesofservices.BPAsarenotcontractsanddonotobligategovernmentfundsinanyway.Acontract
occursupontheplacementofacallorreferralfromtheProbation/PretrialServicesOfficeandthevendor’s
acceptanceofthereferral.ReferralswillberotatedamongallthevendorsontheBPA.BPAsarevalidfora
specificperiodoftime,nottoextendbeyondthecurrentfiscalyear.ThetotaldurationofthisBPA,including
theexerciseoftwo12-monthoptions,shallnotexceed36months.BPAswillbeissuedtothosevendors
determinedtobetechnicallyacceptableandofferingthelowestcosttotheGovernment,usingtheEvaluation
CriteriaestablishedinSectionMoftheRequestforProposal.

PROVISIONOFSERVICES
TheUnitedStatesProbationandPretrialServicesOffice(hereafterUSPO/USPSO)shallprovide
aProbationForm45foreachdefendant/personundersupervisionthatauthorizestheprovisionof
services.ThevendorshallprovideservicesstrictlyinaccordancewiththeProbationForm45for
eachdefendant/personundersupervision.TheJudiciaryshallnotbeliableforanyservices
providedbythevendorthathavenotbeenauthorizedforthatdefendant/personunder
supervisionintheProbationForm45.TheUnitedStatesProbationorPretrialServicesOfficer
mayprovideamendedProbationForm45’sduringtreatment.TheUnitedStates
Probation/PretrialServicesOfficewillnotifythevendorinwritingviaProbationForm45when
servicesaretobeterminatedandtheJudiciaryshallnotbeliableforanyservicesprovidedbythe
vendorsubsequenttothewrittennotification.
INTRODUCTION
A.Pursuanttotheauthoritycontainedin18U.S.C.§3154,and3672,contractsor
BlanketPurchaseAgreementsmaybeawardedtoprovideservicesfor
defendants/personsundersupervisionwhoaredrug-dependent,alcohol-
dependent,and/orsufferingfromapsychiatricdisorder.Suchservicesmaybe
providedtofederaldefendants/personsundersupervisionsupervisedbythe
USPO/USPSO,underthetermsofthisagreement.Thevendorshallsubmit
separateinvoicesforservicesprovidedtothereferringagency(USPOor
USPSO).
Noteregardingpretrialservicesdefendants:Thevendorshallnotaskquestions
pertainingtotheinstantoffense(pendingcharges),oraskquestionsoradminister
teststhatcompelthedefendanttomakeincriminatingstatementsorprovide
informationthatcouldbeusedintheissueofguiltorinnocence.Ifsuch
informationisdivulgedaspartofanevaluationortreatment,itshallnotbe
includedonthewrittenreport.
B.TheservicestobeperformedareindicatedinSectionsBandC.Thevendorshall
complywithallrequirementsandperformancestandardsofthisagreement.
C.Thejudiciarywillreferclientsonan“asneededbasis”andmakesno
representationorwarrantythatitwillreferaspecificnumberofclientstothe
vendorforservices.

purposesofthatsection),andtheterm“his/herdulyauthorizedrepresentative”
meansanypersonorpersonsorboard(otherthantheContractingOfficer)

E.“Authorizedrepresentative”meansanyperson,persons,orboard(otherthan

G.“Client”meansanypretrialreleasee,probationer,parolee,mandatoryreleasee,
mandatoryparolee,orsupervisedreleaseereceivingdrug/alcoholtestingand/or
substanceuseassessment/treatment,mentalhealth
assessment/evaluation/treatment,andorsexoffensespecific
evaluation/treatment/testingwhileunderthesupervisionoftheFederalProbation
orPretrialServicesSystem.Hereinafter,thetermdefendantappliestothoseon
pretrialsupervision,whereaspersonundersupervisionappliestothoseonpost-
convictionsupervision.
H.“U.S.ProbationOfficer”(i.e.,USPO)meansanindividualappointedbythe
UnitedStatesDistrictCourttoprovidepretrial,presentenceandsupervision(pre
andpostsentence)servicesforthecourt.“ProbationOfficer”referstothe
individualresponsibleforthedirectsupervisionofaclientreceivingdrug/alcohol
testingand/orsubstanceuseassessment/treatment,mentalhealth
assessment/evaluation/treatmentand/orsexoffensespecific
evaluation/treatment/testing.
I.“ChiefU.S.ProbationOfficer”(i.e.,CUSPO)meanstheindividualappointed
bytheUnitedStatesDistrictCourttosupervisetheworkofthecourt’sprobation
staff.Forthepurposeofthecontract,the“ChiefProbationOfficer”actsasthe
contractadministratoronbehalfoftheDirectoroftheAdministrativeOfficeof
theUnitedStatesCourts.
J.“U.S.PretrialServicesOfficer”(i.e.,USPSO)meanstheindividualappointed
byaUnitedStatesDistrictCourttoprovidepretrialreleaseinvestigations,
recommendationsandsupervisionservicesforthatcourt.“PretrialServices
Officer”referstotheindividualresponsibleforthedirectsupervisionofaclient

receivingdrug/alcoholtestingand/orsubstanceuseassessment/treatment,mental
healthassessment/evaluation/treatment,and/orspecializedtreatmentforpretrial

K.“ChiefU.S.PretrialServicesOfficer”(i.e.,CPSO)meanstheindividual
appointedbythecourttosupervisetheworkofthecourt’spretrialservicesstaff.
Forthepurposeofthecontract,the“ChiefProbationOfficer”actsasthecontract
administratoronbehalfoftheDirectoroftheAdministrativeOfficeoftheUnited
StatesCourts.
L.“Designee”meansthepersonselectedbytheChiefProbationOfficerortheChief
PretrialServicesOfficertoactinhis/herbehalfindrug,alcohol,andmental
healthtreatmentmatters.
M.“FederalBureauofPrisons”isthefederalagencyresponsibleforhousing
inmatesinfederalprisons,penitentiaries,correctionalinstitutionsandresidential
re-entrycenterswhohavebeensentencedbythefederalcourts.
N.“Clarifications”arelimitedexchanges,betweentheJudiciaryandofferorsthat
mayoccurwhenawardwithoutdiscussionsiscontemplated.Ifawardwillbe
madewithoutconductingdiscussions,offerorsmaybegiventheopportunityto
clarifycertainaspectsofproposalsortoresolveminororclericalerrors.
O.“AOUSC”referstotheAdministrativeOfficeoftheU.S.Courts.
P.“USPO/USPSO”referstotheU.S.ProbationOfficer/U.S.PretrialServices

Allresidential,housingandinpatientserviceslistedaboveshallbeprovidedatfacilities
thatarelicensedbythestateandlocality(ifapplicable)inwhichtheyarelocatedandare
incompliancewiththeResidentialFacilityRequirements(below).
a.Defendant/PersonundersupervisionInformation
Thevendorshallobtainatintake:theresident’sname;homeaddress;dateofbirth;
race;gender;andspecialmedicationproblemsorneeds;thenameoftheresident’s
personalphysician(ifapplicable);theresident’slegalstatusincludingconditions
ofrelease;andthenamesofpartiestonotifyincaseofanemergency.Thevendor
shallimmediatelynotifytheUSPO/USPSO,orfollowothernotificationprotocol
outlinedbytheUSPO/USPSO,ifthedefendant/personundersupervisionleaves
thetreatmentfacilitywithoutproperauthorization,failstoreportfortreatment,or
anyfactorsthatmayincreaseriskoridentifiedthird-partyriskissues.Thevendor
shallreportconductviolatingaconditionofsupervisionwithin24hours.
b.StaffQualifications
Thevendorshallensurethatthefacilities:
(1)Haveadequatelytrainedandphysicallyable,paidstaffonduty/premises
toprovide24hours,7-daysaweekcoverage.(Staffmaynotbeasleep
duringtheirassignedshifts);
(2)UsevolunteersonlyatthediscretionoftheUSPO/USPSO;
(3)Keepwrittenpositiondescriptionsthataccuratelydescribecurrentduties
forallstaffperformingservicesunderthisagreement;
(4)Establishminimumemploymentqualificationsforallstaffperforming

servicesunderthisagreement;
(5)Have,ataminimum,onestaffmemberoneachshiftthatistrainedin
emergencyCPRandfirstaid;

(a)anadvanceddegree(mastersordoctorallevel)inbehavioralscience,
preferablypsychologyorsocialwork,or
(b)aBA/BSandatleasttwoyearsofdrugtreatmenttrainingand/or
experience;
(7)Havecounselorsthatarecertifiedand/orhavecredentialstoengagein
substanceusetreatmentinterventionrecognizedbythestateorlocal
certifyingauthority;and
(8)Onlyuseparaprofessionalsunderthesupervisionofastaffmemberwho
meetstherequirementsdescribedinitem(6)(a)and(b)above,andafter
obtainingtheapprovalofthecontractingofficerordesignee.Internsmay
beconsideredparaprofessionals.

Thevendorshall:

supervisionandshallbepostedconspicuouslyinthefacility.

Thevendorshallprovide:

h.DepartmentofHealth,EducationandWelfareFoodServiceStandards
TheU.S.FoodandDrugAdministration(FDA)publishestheFoodCode,a
modelthatassistsfoodcontroljurisdictionatalllevelsofgovernmentby
providingthemwithascientificallysoundtechnicalandlegalbasisfor
regulatingtheretailandfoodservicesegmentoftheindustry(restaurantsand
grocerystoresandinstitutionssuchasnursinghomes).Local,state,tribaland
federalregulatorsusetheFDAFoodCodeasamodeltodeveloporupdatetheir
ownfoodsafetyrulesandtobeconsistentwithnationalfoodregulatorypolicy.

AidManualon-siteatalltimes.
(2)Trainatleastonestaffmemberoneachshiftinemergencyfirstaidand
CPR.
(3)Ensurethatemergency24hour,7-daysaweekmedicalserviceis
availablewithalicensedgeneralhospital,privatephysicianorclinic.
(4)Ensurethatresidentsareresponsiblefortheirownmedicalexpensesand
thatstaffassistsresidentsinidentifyingavailablecommunityresources.
k.CounselingandProgrammaticRequirements(PC2001,2002,6001,6002)
Thevendorshallprovide:
(1)Aminimumof6hoursofstructuredprogrammaticactivitiesperweekday
(e.g.,lifeskillstraining,GED,employmentreadiness,etc.),3hoursof
whichshallbeclinicalgroupcounseling,aswellasaminimumof3
hoursofstructuredprogrammaticactivitiesperweekendday.
(1)Aminimumof1hourofindividualclinicalcounselingperweek.
(2)Atreatmentplaniscreatedatwiththedefendant/personundersupervision
atthebeginningofprogrammingwhichshallinclude,butisnotlimitedto:
(1)shortandlong-termgoalsthedefendant/personundersupervisionwill
beattemptingtoachieve(forpost-conviction,goalsshouldrelatetothe
personundersupervision’srisk,needs,andresponsivity,asprovidedbythe
USPO/USPSO);(2)measurableobjectiveswhichrelatetotheachievement
ofthecorrespondinggoals;(3)specificcriteriafortreatmentcompletion;
and(4)theanticipatedtime-frameforcompletionofprogramming.
Treatmentplansshallbereviewedatleastevery30days,andincludethe
defendant’s/personundersupervision’sinput,updatestoitems(1)-(4)
aforementioned,justificationforcontinuedneedfortreatment,andany

feedbackprovidedbyUSPO/USPSO.Theplanshallincludeinformation
onfamilyandanysignificantothersinvolvement(i.e.,communitysupport

notificationprotocoloutlinedbytheUSPO/USPSO,ifthedefendant/person
undersupervisionleavesthetreatmentfacilitywithoutproperauthorization,
failstoreportfortreatment,oranyfactorsthatmayincreaseriskoridentified
third-partyriskissues.Thevendorshallreportconductviolatingaconditionof
supervisionwithin24hours.
4.Defendant/PersonundersupervisionTransportation
Thevendorshallprovide:
a.Defendant/PersonundersupervisionTransportationExpenses(1202)for
defendant/personundersupervisiontransportationtoandfromtreatmentfacilities:
(1)Foreligibledefendants/personundersupervisionwhotheUSPO/USPSO
determinesareunemployedorunabletopaytransportationprices,
(2)ThattheUSPO/USPSOauthorizesandapproves,and
(3)Thatdoesnotexceedthepriceofpublictransportationviathemostdirect
route.
Ifpublictransportationisnotavailable,thevendormustseekpriorapprovalfrom
thecontractingofficerordesigneeforreimbursementofalternative
meansoftransportationaccordancewiththeJudiciaryTravelRegulations
(JTR).
Note:ThevendormaychargeanAdministrativeFee(1201)forDefendant/Person
undersupervisionTransportationExpenses(1202)whichisareasonablemonthlyfee
toadministertransportationexpensefunds,notexceedingfive(5)percentofthemonthly
fundsdistributedunderDefendant/PersonundersupervisionTransportationExpenses
(1202).
5.Deliverables

bespecifiedbytheUSPO/USPSO,e.g.papercopy,flashdrive,electronic
access,etc.)immediatelyuponrequestoftheUSPO/USPSOordesignee.
(b)Ifmaintainingpaperfiles,segregatedefendant/personundersupervision
filesfromothervendorrecords.Thiswillfacilitatemonitoringand
promotedefendant/personundersupervisionconfidentiality.

(d)Createaseparatefilewhenadefendantonpretrialservicessupervisionis
sentencedtoprobationsupervision,butcontinuedintreatmentwiththe

coveredunderthePretrialServicesConfidentialityRegulations.
(e)Identifyanyrecordsthatdisclosetheidentityofadefendant/personunder
supervisionasCONFIDENTIAL.
(f)Keepalldefendant/personundersupervisionrecordsforthreeyearsafter
thefinalpaymentisreceivedforJudiciaryinspectionandreview,except
forlitigationorsettlementofclaimsarisingoutoftheperformanceofthis
agreement,whichrecordsshallbemaintaineduntilfinaldispositionof
suchappeals,litigation,orclaims.Note:thisrequirementisnotinlieuof
thevendorfollowingotherlocal/state/federalrecordretention
requirements.
(g)Attheexpirationoftheperformanceperiodofthisagreementthevendor
shallprovidetheUSPO/USPSOordesigneeacopyofall
defendant/personundersupervisionrecordsthathavenotbeenpreviously
furnished,includingcopiesofchronologicalnotes.

6.NotifyingUSPO/USPSOofDefendant/PersonundersupervisionBehavior
Thevendorshall:
a.NotifytheUSPO/USPSO,orfollowothernotificationprotocoloutlinedbythe
USPO/USPSO,within24hoursorasspecifiedinwritingbytheContracting
Officerofdefendant/personundersupervisionbehaviorincludingbutnotlimited
to:
(1)Positivedrugoralcoholtestresults.
(2)Attemptstoadulterateaurinespecimenand/orcompromiseanydrug

7.StaffRequirementsandRestrictions
Thevendorshallensurethat:
a.Afteraward,personscurrentlyunderpretrialservices,probation,parole,
mandatoryrelease,orsupervisedrelease(federal,stateorlocal)shallnotperform
servicesunderthisagreementnorhaveaccesstodefendant/personunder
supervisionfiles.
b.Afteraward,personschargedwithorunderinvestigationforacriminaloffense
shallnotperformservicesunderthisagreementnorhaveaccessto
defendant/personundersupervisionfilesunlessapprovedinwritingbythe
ContractingOfficerafterconsultationwithPPSOandPMD.
c.Afteraward,personsconvictedofanysexualoffense(includingbutnotlimitedto,
childpornographyoffenses,childexploitation,sexualabuse,rapeorsexual
assault)orrequiredunderfederal,state,orlocallawtoregisterontheSexual
Offenderregistryshallnotperformservicesunderthisagreementorcontractnor
shalltheyhaveaccesstodefendant/personundersupervisionfilesunlessapproved
inwritingbytheContractingOfficerafterconsultationwithPPSOandPMD.

d.Afteraward,personswithanyrestrictionsontheirlicenses,certificationsor
practice(orthosewhovoluntarilyagreetosucharestriction)basedonnegotiations

supervisionfilesunlessapprovedinwritingbytheContractingOfficerafter

e.Thevendorsanditsemployeesshall:
(1)Avoidcompromisingrelationshipswithdefendants/personunder
supervisionandprobationorpretrialservicesstaff,and
(2)Notemploy,contractwith,orpayanydefendant/personundersupervision
ordefendant’s/personundersupervision’sfirmorbusinesstodoanywork
forthevendoreitheratthevendor’sfacilitiesorpersonallyforanyofthe
vendor’semployeesduringtheperiodofthisagreement.
(3)Reportanysuchimproprietiesortheappearancethereofimmediatelytothe
USPO/USPSOordesignee.
(4)ReporttotheUSPO/USPSOanyinvestigations,pendingcharges,arrests
and/orconvictionsrelatedtoacriminaloffense,anyrestrictionsonstaff
licensesorcertifications,whetherimposedorvoluntary,involvinganystaff
performingservicesunderthisagreementwithin48hoursofobtaining
knowledge.
f.ThevendorshallnotifytheUSPO/USPSOinwritingofanystaffchangesand
providedocumentationofanyrequiredlicensing,certification,experienceand
educationrequirements,orchangesthereof.ThevendorshallsubmitanOfferor’s
StaffQualificationsform(SectionL-AttachmentC)foreachnewstaffmember
addedundertheagreement.
g.Failuretocomplywiththeabovetermsandconditionscouldresultintermination
ofthisagreement.
8.FacilityRequirements:
Thevendorshallensurethatitsfacility(ies)hasadequateaccessfordefendants/person
undersupervisionwithphysicaldisabilities.
Shouldavendorand/orsubcontractorchoosetorelocateafacilitywithinthecatchment
area,thevendorshallprovidetheUSPO/USPSOwrittennotificationnolessthan30days

priortorelocationandincludethefacilityaddress.Thevendorshallprovidecopiesofall

H.1Clause7-25,Indemnification(AUG2004)
(a)Thecontractorassumesfullresponsibilityforandshallindemnifythejudiciary
againstanyandalllossesordamageofwhatsoeverkindandnaturetoanyandall
judiciaryproperty,includinganyequipment,products,accessories,orparts
furnished,whileinitscustodyandcareforstorage,repairs,orservicetobe
performedunderthetermsofthiscontract,resultinginwholeorinpartfromthe
negligentactsoromissionsofthecontractor,anysubcontractor,oranyemployee,
agentorrepresentativeofthecontractororsubcontractor.
(b)Ifduetothefault,negligentacts(whetherofcommissionoromission)and/or
dishonestyofthecontractororitsemployees,anyjudiciary-ownedorcontrolled
propertyislostordamagedasaresultofthecontractor'sperformanceofthis
contract,thecontractorshallberesponsibletothejudiciaryforsuchlossor
damage,andthejudiciary,atitsoption,may,inlieuofrequiringreimbursement
therefor,requirethecontractortoreplaceatitsownexpense,allpropertylostor
damaged.
(c)Hold Harmless and Indemnification AgreementThecontractorshallsaveandhold
harmlessandindemnifythejudiciaryagainstanyandallliabilityclaimsandcostof
whatsoeverkindandnatureforinjurytoordeathofanypersonorpersonsandfor
lossordamagetoanycontractorpropertyorpropertyownedbyathirdparty
occurringinconnectionwithorinanywayincidenttoorarisingoutofthe
occupancy,use,service,operation,orperformanceofworkunderthetermsofthis
contract,resultinginwholeorinpartfromtheactsoromissionsofthecontractor,
anysubcontractor,oranyemployee,agent,orrepresentativeofthecontractoror
subcontractor.
(d)Thecontractorshallindemnifyandholdthejudiciary,itsemployees,andothers
actingonitsbehalfharmlessagainstanyandallloss,liability,ordamagearising
outofthenegligence,failuretoact,fraud,embezzlement,orothermisconductby
thecontractor,itsemployees,subcontractors,agents,orrepresentativesofthe
contractororsubcontractor.
(e)Judiciary's Right of RecoveryNothingintheaboveparagraphswillbeconsidered
toprecludethejudiciaryfromreceivingthebenefitsofanyinsurance/bondsthe
contractormaycarrywhichprovidesfortheindemnificationofanylossor
destructionof,ordamagesto,propertyinthecustodyandcareofthecontractor
wheresuchloss,destructionordamageistojudiciaryproperty.Thecontractor
shalldonothingtoprejudicethejudiciary'srighttorecoveragainstthirdpartiesfor
anyloss,destructionof,ordamageto,judiciaryproperty,andupontherequestof
thecontractingofficerwill,atthejudiciary'sexpense,furnishtothejudiciaryall

"Criminaldrugstatute"meansaFederalornon-Federalcriminalstatute

connectionwithaspecificcontractatwhichtheemployeesoftheContractorare

vendorinitscommercialmarketinginitiatives,insuchawaythatitrepresentsor
impliesthatthejudiciaryprefersorendorsestheproductsorservicesofferedbythe
contractor.Thisprovisionwillnotbeconstruedaslimitingthecontractor'sability
torefertothejudiciaryasoneofitscustomerswhenprovidingpastperformance
informationaspartofaproposalsubmission,asopposedtogeneralpublic
marketing.
(b)Nopublicreleaseofinformationpertainingtothiscontractwillbemadewithout

I.2Subcontracting
Servicesthatthevendorproposestorefertootherserviceprovidersshallbeconsidered
subcontracting.Thevendor(primecontractor)maysubcontracttheprovisionoftreatment
servicestootherserviceproviders(subcontractors).Afteraward,anyproposed
subcontractorarrangementsorchangestotheexistingsubcontractorarrangementsare
subjecttotheContractingOfficer’sapproval,andshallbesubmittedinwritingtothe
ContractingOfficeratleast30daysinadvanceoftheproposedsubcontracting
arrangementorchange.TheContractingOfficerwillrespondpromptlywithwritten
approvalordisapproval.Theprimecontractorshallnotreferdefendants/offenderstoany
othervendorthathasnotbeenapprovedbytheContractingOfficerinwriting.The
governmentreservestherighttorevokeapprovalofanysubcontractoratanytimethat

Theprimecontractorisresponsibletothejudiciaryforoverallperformanceoftheservices

contract/agreement,includingthequalificationsofanypersonnelprovidingservices;the
possessionandmaintenanceofallappropriatestateandlocallicensesincompliancewith
